PACT ACT Compliance
Introduction
Welcome to the HQD Smoke Shop PACT Act information page. Here we explain how the PACT Act (Prevent All Cigarette Trafficking Act) affects the sale and shipment of nicotine products, including certain vaping products.
The PACT Act is a federal law that regulates the sale, shipment, and taxation of tobacco products, and has been expanded to cover many electronic nicotine delivery systems (ENDS) such as vape pens, e-cigarettes, and some disposable vapes. It sets strict rules designed to prevent illegal sales, protect minors, and ensure that all applicable taxes are paid.
This page provides a general overview for our customers and partners. It is not legal advice.
What is the PACT Act?
The Prevent All Cigarette Trafficking (PACT) Act is a U.S. federal law originally created to address the illegal trafficking of cigarettes and smokeless tobacco. With changes in the law and in the nicotine market, the PACT Act was later expanded to include many types of vaping products and ENDS.
Under the expanded rules, businesses that sell covered vaping products must follow strict requirements related to:
-
Shipping and delivery
-
Age verification
-
Tax collection and reporting
-
Registration with federal and state authorities
-
Record-keeping and reporting
Failure to comply can result in significant penalties, including fines and possible criminal charges.
Key Provisions Affecting Vaping Products
1. Shipping Restrictions
The PACT Act places strong limitations on how covered vaping products can be shipped:
-
Certain carriers do not ship ENDS products directly to consumers under the PACT Act.
-
Where shipping is permitted, sellers must use methods that support age verification, adult signature (where required), and detailed record-keeping.
-
Sellers must maintain accurate shipping records, including names, addresses, and quantities, and keep them for a specified period of time.
Because of these rules, availability of direct-to-consumer shipping for vape products may be limited or restricted in some areas.
2. Taxation
Under the PACT Act, applicable federal, state, and local excise taxes must be properly collected and paid on covered products, similar to traditional tobacco:
-
Sellers must determine which taxes apply in the destination state or locality.
-
They may be required to file regular tax reports with state tax authorities.
-
These tax requirements can affect the final price consumers pay and the way products are distributed.
3. Registration & Reporting
Retailers, distributors, and manufacturers who sell covered vaping products across state lines may be required to:
-
Register with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
-
Register with state tax authorities in states where products are shipped.
-
Submit periodic reports detailing shipments, customers, and tax-related information, as required by law.
These requirements are intended to create more transparency and oversight in the sale and distribution of nicotine products.
4. Penalties for Non-Compliance
The PACT Act includes serious penalties for businesses or individuals who do not comply with its rules, including:
-
Significant civil fines
-
Possible criminal penalties
-
Seizure of products and other enforcement actions
Because of the potential consequences, all businesses in the vaping and tobacco space must take compliance very seriously.
